End User License Agreement

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, solely for your personal, non-commercial purposes, subject to this EULA and the Apple Media Services Terms and Conditions or Google Play Terms of Service (as applicable).

2. Subscription Terms

2.1 Subscription Plans

VidsCut offers subscription plans (Starter, Pro, Unlimited) that provide additional features and higher usage limits. Subscriptions are billed through your Apple App Store or Google Play Store account.

2.2 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

2.3 Management and Cancellation

You can manage or cancel your subscription at any time through your device's account settings (Apple: Settings → Apple ID → Subscriptions; Android: Play Store → Subscriptions).

3. AI Processing Consent

3.1 Third-Party AI Services

The App uses the following third-party AI services to process your video content:

• Google Gemini AI (Google LLC) — analyzes video frames for scene detection and subject identification
• OpenAI Whisper (via Replicate, Inc.) — transcribes audio for subtitle and caption generation

3.2 Consent Requirement

Before your video content is sent to these AI services, you will be asked to provide explicit consent. You may decline AI processing and use manual edit mode instead.

3.3 Consent Withdrawal

You may withdraw your AI processing consent at any time through Settings → AI Data Processing. After withdrawal, your videos will not be sent to third-party AI services.

3.4 Data Handling

Your video content sent to AI services is processed solely for the purpose of providing the editing service. It is not used to train AI models or shared for advertising purposes.

4. Content Ownership

4.1 Your Content

You retain all ownership rights to the original video clips you upload and the edited videos you create using the App.

4.2 License to Process

By uploading content and consenting to AI processing, you grant us a temporary, limited license to process your content through our services and third-party AI providers solely for the purpose of delivering the editing service. This license terminates when your content is deleted from our servers.

4.3 Our Intellectual Property

We retain all rights to the App, its design, code, features, and underlying technology.

5. AI Output Disclaimer

5.1 Automated Results

Edit plans, scene analysis, and transcriptions generated by AI services are automated outputs. We do not guarantee their accuracy, completeness, or suitability for any particular purpose.

5.2 No Liability for AI Outputs

We are not liable for any errors, omissions, or unintended results produced by AI-generated edit plans or transcriptions. You are responsible for reviewing and approving all edits before rendering.

6. Prohibited Content

You agree NOT to upload or process content that:

• Is illegal under any applicable law
• Contains child sexual abuse material (CSAM) or depicts minors in any exploitative manner
• Contains explicit sexual content or pornography
• Promotes violence, self-harm, or terrorism
• Contains hate speech or promotes discrimination
• Infringes intellectual property rights
• Is defamatory, harassing, or threatening

We reserve the right to use automated content moderation to screen uploads. Violation may result in immediate account termination.

7. Termination

7.1 By You

You may stop using the App and delete your account at any time through Settings.

7.2 By Us

We may suspend or terminate your access if you violate this EULA, the Terms of Service, or applicable law. Upon termination, your license to use the App is revoked.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

9. Apple-Specific Terms

If you downloaded the App from the Apple App Store:

• This EULA is between you and VidsCut, not Apple. Apple has no obligation to furnish maintenance or support services for the App.
• Apple is not responsible for any claims relating to the App, including product liability, regulatory compliance, or intellectual property infringement.
• Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

10. Changes to This EULA

We may update this EULA from time to time. Material changes will be communicated via the App. Continued use after changes constitutes acceptance.
